Death Eaters QUestion?(From harry potter)?

OK so if all death eaters have the dark mark on there arm how come when the ministry of magic accuses people they dont check if they have the dark mark. Like sirius they chucked him in azkaban and he didnt have the dark mark how come they dont check AM I MISSING SOMETHING
